Bile Duct Injury Case Study

Lots of people suffer from bile duct injuries due to the negligence of a medical professional. Mrs A was 39 years old when she was referred to Dr S who after conducing tests made a diagnosis of acute cholecystitis. Plans were made for Mrs A to undergo surgery, but during the procedure Dr S clipped and divided the bile duct and hepatic duct by mistake and this went un-noticed so no repair job was carried out.

Two days later Mrs A was discharged from hospital but over the next 24 hours her pain worsened and she phoned Dr S's secretary for some advice. She was then advised to return to the hospital for tests to find out the source of her pain.

When she was examined Dr S noted that Mrs A was suffering from mild jaundice and her abdomen was tender, which are symptoms of a bile duct injury. She was booked for an ultrasound scan the net morning but during the night her conditioned worsened and she was sent for the scan early. The ultrasound picked up the damage done to her bile duct and she immediately underwent reconstructive surgery in order to repair the damage.

Mrs A is still under the care of her consultant due to the medical negligence and undergoes an annual liver function test which will continue for at least 10 years following the reconstructive surgery. There is a small risk that she will require further surgery, and in a worst case scenario she may require a liver transplant later in life.

Mrs A made a medical negligence compensation claim against Dr S for her bile duct injury and despite the doctor denying liability she received damages for the injury suffered alongside a claim for partial, future and past loss earnings on the grounds that Mrs A has not been able to take up full time employment which she had planned to do when her children began full time education.

The senior associate who handled Mrs A claim commented that "Mrs A's life had been changed by the trauma of what she went though after what she had expected was a simple operation".
