Frequently Asked Questions

Why should I claim with Bile Duct Injury Helpline?

Here at Bile Duct Injury Helpline we have a specialist panel of solicitors who deal with medical negligence cases surrounding bile duct injuries. Our panel members sympathise with how you feel, are compassionate and are available to provide legal advice to guide you through this difficult time.

Will I have to pay for this service?

Our panel of solicitors usually work on a no-win, no-fee basis so if you make a claim through Bile Duct Injury Helpline you won't be charged any up front fee's and if your case doesn't win then you won't have to pay the solicitor.

How long will the claim take before I receive my compensation payout?

Each and every case is different and has it's own circumstances so it's hard to know how long your claim will take to process. All medical negligence cases have to be handled with the care they deserve and Bile Duct Injury Helpline will do everything to get you the best result possible. Bare in mind some cases may take longer to settle than others but the average time frame is usually between 2 months and 3 years.

How do medical negligence claims differ from other compensation claims?

Medical negligence claims differ from other types of claims in a number of ways. Unfortunately these types of claims can take longer to reach a conclusion due to the complex nature of them. But here at Bile Duct Injury Helpline we will constantly keep you informed of the progress of your claim and complete things as quickly as possible.

Who can I claim against?

When medical negligence occurs, any medical practitioner whether they are private or in the NHS can be held liable for injuries caused and can be sued for compensation.

How does the claims process work?

Step 1- Contact us via email or telephone.
Step 2- We will obtain all of the relevant details and submit them onto our panel of specialist solicitors.
Step 3- The specialist solicitor allocated to your case will contact you within 48 hours to confirm the details provided.
Step 4- Solicitors will send out their introduction letter along with documents which cover the terms and conditions, complaints process etc.
Step 5- Once the solicitor has received your forms back they will send a letter out to the other party telling them of intent to make a personal injury claim and to identify their insurers.
Step 6- The other party then has a number of weeks to provide this information (Please note not all parties correspond within the given time frame or there may be difficulty in identifying the owner or insurer so there could be a slight time delay)
Step 7- If all goes well and they respond in time then correspondance will begin.
Step 8- Your medical evidence relating to your injury or ongoing condition if you have not recovered will be shared.
Step 9- Your solicitor will have permission to access your medical records or you may be sent to see a medical professional.
Step 10- If it is a straight forward claim and the other party accept liability for your accident they will make you an offer for your personal injury compensation claim.
Step 11- Your solicitor will advise you of the offer and advise you whether it is a reasonable amount or whether you should make a counter offer.
Step 12- Before any money is accepted your solicitor will advise you in writing.
Step 13- Hopefully an amount will be agreed between you and the other party which means it will avoid going to court.

Will I need to attend my solicitors office or court?

Normally you will not be required to visit your solicitors office as most contact will be done via email and telephone. Although you may be required to visit a medical professional to get a second opinion on your injuries. In regards to court, it is rare that cases go to court as this requires a lot of resources, so most parties will try and avoid getting to this point. Bile Duct Injury Helpline will work with you and the other party to try and avoid it coming to court.
